CDP DISCUSSION
The Rehoboth Beach Homeowners’ Association is holding a Board meeting on Saturday, September 17, 2005 at the All Saints Episcopal Church at 18 Olive Street. [Note: this is a change in location.] The meeting will start at 9:00 am and will feature a description of plans for the implementation of the CDP by Commissioner Patrick Gossett. Monday, September 19, 2005 is the next regular City meeting. Under Old Business, Streetscape will be updated. Will there be money? Stay tuned! There are three New Business items: (1) Approval of change order to add construction of restroom and pavilion to contract with Daisy Construction, (2) Presentation of Lynch Well Facility Plan by Bob Palmer of Davis, Bowen & Friedel, and (3) Appointments to the Planning Commission. And the envelope please. Or put another way, why don’t we know who is being considered; there’s five slots being filled!

ATLANTIC SANDS VARIANCE REQUEST
In July 2005 we reported to you about a variance proceeding that had been scheduled later that month. The matter was cancelled from the July meeting. We informed you that the Board of Adjustment was going to consider the Atlantic Sands Hotel’s variance request, “not to include the underground parking garage parking square footage space in the FAR (floor area ratio) calculations.” According to information the RBHA had received the hotel planned a significant expansion of the property through acquisition of the Epworth United Methodist Church parking lot. Ten additional hotel rooms, a conference center, two restaurants, and more parking are envisioned. The multi-story structure would be extended to the property line adjacent to the Camel’s Hump Restaurant.
It appears that the Atlantic Sands has an agreement of sale to purchase from Epworth Methodist the parking lot at 17 and 19 Baltimore Avenue. We understand that the Atlantic Sands on July 27, 2005, filed another application for a waiver of certain requirements of the Rehoboth Beach Zoning Code; the application is similar to the original filing and seeks to extend the existing hotel onto the Epworth property.
RBHA Member William Barnes has offered RBHA the following additional information, “The extension will include basement parking, two restaurants, 10 hotel suites, and a two-story meeting room. It would appear that the agreement with Epworth is contingent upon the Sands being relieved of the 50% lot coverage restriction and the floor area ratio of 2.0 in the Zoning Code. According to our calculations, the average floor coverage for the Sands with the new addition will be 44,768 square feet when it should not exceed 50% of the gross lot area, which is 35,450 square feet. The proposal exceeds the allowable lot coverage by 26.29%. The floor area ratio (FAR) of the Sands with the new addition is 3.16. This far exceeds the allowable FAR of 2.0 or the former FAR of 2.84. A superficial physical examination of the existing Sands structure shows that it presently occupies substantially in excess of 50% lot coverage. The proposed addition will occupy 100% of the area inside the property line with the concrete roof of the basement garage, two restaurants, 10 hotel suites, and a large meeting room. This violates the purpose of the Zoning Code, which, among other things, is to lessen congestion in the streets, to provide adequate light and air, to prevent overcrowding of land, and to avoid undue concentration of population.”

The Board of the Rehoboth Beach Homeowner’s Association at its July 16, 2005 Board meeting voted unanimously to oppose the application of the Sands Hotel. The hearing on the current application is scheduled for Monday, September 26, 2005, at 7:00 p.m. in the Board Room of City Hall. An RBHA representative will attend the meeting to express our opposition. As we did in July, we urge you to attend the September Board of Adjustment meeting to show your support for the RBHA action to oppose this request. Remember, a strong show of people opposed to such matters can often have the desired persuasive effect.
TREES
The Parks & Shade Tree Committee met on Tuesday. Chaired by Commissioner Kathy McGuiness, discussion centered around two other city tree ordinances, Milford, DE and Chapel Hill, NC. Kyle Gulbronson, the CDP consultant from URS Corp, facilitated the discussion. Mr. Gulbronson opened the meeting by asking the attendees, “What do you want?” For the next hour he guided the talk through eleven items that could make up a tree ordinance. He presented a “Comparison Table” contrasting the significant components of the Milford and Chapel Hill ordinances with the Rehoboth Beach draft ordinance.
Ms. McGuiness noted that the first “Open House” meeting for the CDP was scheduled for October 8, 2005 [no time yet]. She said the work being accomplished by her committee will be one of the focal points of the Open House.
